Howard Krongold, a leading appeal specialist who filed the successful appeal, said: “This was a troubling conviction built on a bizarre confession my client made, while he was exhibiting symptoms of schizophrenia, in order to escape being held in solitary confinement at the Ottawa jail. As the Court of Appeal has recognized, this trial was unfair because the Crown elicited from the investigating officer his personal opinion about my client’s guilt, and there is every chance the jury was influenced by this evidence. The Court found that Mr. Daou is entitled to new trial, where we hope the errors of the first proceeding can be put right.”
